This document is an electronic record under the Information Technology Act, 2000, applicable amendments, and rules thereunder. This record is generated by a computer system and does not require any physical or digital signatures.

Please read these Terms of Use carefully before registering, accessing, or using Flamingo Money Services. These terms form a binding legal contract (“Agreement”) between You and Flamingo Money (“Company”, “Flamingo”, “We”, “Our”, “Us”).

By downloading, registering, or using Flamingo’s app, website, or services (collectively, the “Platform”), you agree to abide by these Terms. If you do not agree, you must discontinue using the Platform and uninstall the app.

We reserve the right to modify these Terms at any time. Updates will be effective immediately upon posting on the Platform. Continued use after updates implies acceptance of the revised Terms.

Definitions

• “You”, “User” – Any registered user of the Flamingo Platform.

• “Platform” or “App” – The Flamingo Money mobile application and website.

• “Services” – Includes, but is not limited to, Digital Gold/Silver investments, Couple Vault, Gold FD, Save on Spend, Streak Challenges, Flamingo Coins, and related features.

• “Business Partners” – Entities Flamingo has contractual relationships with, including Augmont GoldTech Private Limited (bullion provider), payment partners, and compliance agencies.

Eligibility

By accessing Flamingo Services, you confirm that:

1. You are at least 18 years of age and an Indian citizen.

2. You are legally capable of entering into a binding contract.

3. You are not impersonating another person or entity.

4. All information and KYC documents provided are true, complete, and valid.

5. You are not a GST-registered dealer. If your tax status changes, you agree to notify us immediately.

6. You understand and accept the risks of investing in gold/silver and other features offered by Flamingo.

Registration and Account

1. To use Services, you must create a Flamingo Account with accurate and updated details.

2. You are responsible for safeguarding your account credentials.

3. Flamingo may suspend or terminate your account if information provided is inaccurate, incomplete, or fraudulent.

4. Some services (e.g., Gold FD, Couple Vault, Mandates) may require additional verification.

Flamingo Services

Flamingo offers:

• Digital Gold & Silver Investments – Facilitated via Augmont GoldTech Pvt. Ltd.

• Gold FD – Lock-in deposits with additional gold rewards.

• Couple Vault – Shared savings and investments between two users.

• Save on Every Spend – Auto-investment feature linked to user transactions.

• Streak Challenges – Habit-based savings challenges (3–101 days).

• Flamingo Coins – In-app reward currency earned through challenges.

Flamingo acts solely as a platform provider; all bullion-related services are managed by Augmont. By using these services, you also agree to Augmont’s Terms & Conditions (https://www.augmont.com/terms-conditions).

KYC & Compliance

• PAN and other Officially Valid Documents (OVDs) are required for regulatory compliance.

• KYC details may be shared with partners (e.g., Augmont, Cashfree) for fraud prevention and legal requirements.

Restrictions on Use

You agree not to:

1. Copy, reproduce, or redistribute any Platform content.

2. Misuse Flamingo services for unlawful or fraudulent purposes.

3. Interfere with the functioning of the Platform or harm other users.

4. Use the Platform for commercial resale of Services.

Transactions, Pricing & Taxes

1. Gold/Silver prices are dynamic and linked to market rates via Augmont.

2. Payments must be made via UPI or other supported methods.

3. GST (currently 3%) and other taxes apply on gold purchases.

4. You are responsible for your personal income tax obligations.

Delivery, Storage & Insurance

• Gold purchased is securely stored in Augmont’s vaults.

• Free storage is provided for a specified period; charges may apply later.

• Gold is insured by Augmont against risks like fire, theft, or natural disasters (excluding war, nuclear risks, etc.).

• Physical delivery of gold is available upon request with applicable charges.

Rewards, Offers & Promotions

• Flamingo may offer discounts, Flamingo Coins, or rewards.

• Offers cannot be combined unless explicitly allowed.

• Flamingo reserves the right to withdraw or alter offers at any time.

Intellectual Property

All intellectual property rights, including software, branding, content, and design of Flamingo Money, are owned by the Company. Users are granted a limited, personal, non-transferable license to use the Platform.

Termination

Flamingo may suspend or terminate your account without notice if:

• You breach these Terms.

• Required by law or regulation.

• Fraudulent or suspicious activity is detected.

You may request account deletion by contacting support@flamingo.money.

Limitation of Liability

• Investments in gold/silver are subject to market risks; returns are not guaranteed.

• Flamingo is not liable for losses due to market fluctuations, system outages, third-party failures, or force majeure events.

• Aggregate liability of Flamingo shall not exceed the commission earned on the transaction giving rise to such liability.

Indemnification

You agree to indemnify and hold Flamingo, its directors, employees, and partners harmless against claims, damages, or expenses arising from:

• Breach of these Terms.

• Violation of laws or third-party rights.

• Fraudulent use of the Platform.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts in Ahmedabad, Gujarat shall have exclusive jurisdiction over disputes, unless otherwise required by law.

Disclaimer

• Services are provided on an “as is” and “as available” basis.

• Flamingo does not guarantee uninterrupted, error-free, or profitable use of Services.

• Users must exercise independent judgment in making investment decisions.
